No Lawyers? No Jail. Judge Demands Constitution Be Respected in Louisiana Public Defender Catastrophe

New Orleans Criminal Court Judge Arthur Hunter, a former police officer, ruled that seven people awaiting trial in jail without adequate legal defense must be released. The law is clear. The US Supreme Court, in their 1963 case Gideon v Wainwright, ruled that everyone who is accused of a crime has a Constitutional right a lawyer at the state’s expense if they cannot afford one. However, Louisiana, in the middle of big budget problems, has been disregarding the constitutional right of thousands of people facing trial in its most recent statewide public defender meltdown. Judge Hunter ruled that the Constitution makes it clear: no lawyer, no jail.

In an eleven page ruling, Judge Hunter explained that since Louisiana has failed to adequately fund indigent defense it has violated the Sixth Amendment right to effective assistance of counsel and the Fourteenth Amendment right to Due Process of seven men. The men appearing before Judge Hunter could not be represented by the public defender because of budget cutbacks and private lawyers appointed by the court, who were denied funds for investigation and preparation of the cases, asked that the prosecutions be stopped and their clients released. Hunter ordered the men released but stayed their release until his order could be reviewed on appeal.

The Louisiana public defender system appears to be in the worst crisis of any state in the US. It is a “disaster” according to The Economist, “broken” according to National Public Radio, in “free fall” according to the New York Times, “dire” according to the Chief Justice of the Louisiana Supreme Court, and facing further cutbacks “on a scale unprecedented in the history of American public defense” according to the American Bar Association.

While Louisiana incarcerates more of its people than any of the other 50 states, prosecutions across the state are starting to slow down because of inadequate public defense.

Thirty three of Louisiana’s 42 local public defender offices have started waiting lists for those accused of crimes due to office cutbacks according to the Louisiana Supreme Court. In some death penalty cases there are no lawyers to represent the accused so the cases are being stopped. Volunteer lawyers for those left in jail without public defenders are asking their clients be released.

The problem is that Louisiana refuses to adequately fund its public defender system resulting in layoffs of public defenders. The remaining public defenders who have excessive caseloads are ethically required to stop accepting new cases according to the American Bar Association.

For example, the New Orleans Public Defender office had 78 lawyers in its office in 2009 and has 36 fewer lawyers today. That office has quit taking serious cases resulting in over 100 people with serious crimes having no lawyer, more than 60 sitting in jail. Four years ago the Orleans Public Defender had a budget of $ 9.5 million, today it is down to $ 6 million.

The problem is state-wide. Another example is the Lafayette Louisiana Public Defender which now has 11 fewer full-time attorneys, down to 15 from 26. Their office also cancelled contracts with 26 part-time attorneys, laid off two social workers and everyone who was left were hit with a 20 percent pay cut. That eliminated 37 of their 52 lawyers. Vermillion Parish, which employed 10 public defenders now is down to one.

Although some suggest private lawyers should volunteer or be appointed to take on these cases, the Louisiana State Bar Association passed a resolution objecting. They outlined ethical problems to courts appointing lawyers without criminal experience to represent indigent defendants and further challenged the constitutionality of courts forcing private attorneys to provide uncompensated services for those whom the State should be providing representation.

Volunteer lawyers are also hard to find because those who take up the work of public defenders are not provided malpractice coverage, will likely never be paid, are responsible for their client’s files for 10 years, and are held to high standards in representation.

In Judge Hunter’s case one New Orleans prosecutor accused private lawyers of being anarchists because they asked for release of people facing trial until the lawyers can get reimbursed for their costs and overhead, as the Louisiana Supreme Court has demanded since 1993. In reaction to Judge Hunter’s ruling the prosecutor’s office did not discuss the constitutional issues but said they disagree and plan to appeal to the Louisiana Supreme Court.

Other prosecutors are quite unhappy as well. A Baton Rouge prosecutor accused the public defender of manipulating this crisis to “get rid of the death penalty.”

Judge Hunter concluded his ruling with these words. “The defendants’ constitutional rights are not contingent upon budget demands, waiting lists, and the failure of the legislature to adequately fund indigent defense….We are not faced with a fundamental question, not only in New Orleans, but across Louisiana: What kind of criminal justice system do we want? One based on fairness or injustice, equality of prejudice, efficiency or chaos, right or wrong?”

Realistically, the problem is getting worse soon because the Louisiana Public Defender, which last year handled more than 241,000 cases, is facing a 66 percent reduction in funding beginning in several months, a drop from $ 33 million to $ 12 million.

It seems the only way Louisiana will respect the Constitution is to follow Judge Hunter’s ultimatum. No lawyers? No jail.

Volunteer lawyers are also hard to find because those who take up the work of public defenders are not provided malpractice coverage, will likely never be paid, are responsible for their client’s files for 10 years, and are held to high standards in representation.

One based on fairness or injustice, equality of prejudice, efficiency or chaos, right or wrong?”

Realistically, the problem is getting worse soon because the Louisiana Public Defender, which last year handled more than 241,000 cases, is facing a 66 percent reduction in funding beginning in several months, a drop from $ 33 million to $ 12 million.

It seems the only way Louisiana will respect the Constitution is to follow Judge Hunter’s ultimatum. No lawyers? No jail.

No Lawyers? No Jail. Judge Demands Constitution Be Respected in Louisiana Public Defender Catastrophe

New Orleans Criminal Court Judge Arthur Hunter, a former police officer, ruled that seven people awaiting trial in jail without adequate legal defense must be released. The law is clear. The US Supreme Court, in their 1963 case Gideon v Wainwright, ruled that everyone who is accused of a crime has a Constitutional right a lawyer at the state’s expense if they cannot afford one. However, Louisiana, in the middle of big budget problems, has been disregarding the constitutional right of thousands of people facing trial in its most recent statewide public defender meltdown. Judge Hunter ruled that the Constitution makes it clear: no lawyer, no jail.

In an eleven page ruling, Judge Hunter explained that since Louisiana has failed to adequately fund indigent defense it has violated the Sixth Amendment right to effective assistance of counsel and the Fourteenth Amendment right to Due Process of seven men. The men appearing before Judge Hunter could not be represented by the public defender because of budget cutbacks and private lawyers appointed by the court, who were denied funds for investigation and preparation of the cases, asked that the prosecutions be stopped and their clients released. Hunter ordered the men released but stayed their release until his order could be reviewed on appeal.

The Louisiana public defender system appears to be in the worst crisis of any state in the US. It is a “disaster” according to The Economist, “broken” according to National Public Radio, in “free fall” according to the New York Times, “dire” according to the Chief Justice of the Louisiana Supreme Court, and facing further cutbacks “on a scale unprecedented in the history of American public defense” according to the American Bar Association.

While Louisiana incarcerates more of its people than any of the other 50 states, prosecutions across the state are starting to slow down because of inadequate public defense.

Thirty three of Louisiana’s 42 local public defender offices have started waiting lists for those accused of crimes due to office cutbacks according to the Louisiana Supreme Court. In some death penalty cases there are no lawyers to represent the accused so the cases are being stopped. Volunteer lawyers for those left in jail without public defenders are asking their clients be released.

The problem is that Louisiana refuses to adequately fund its public defender system resulting in layoffs of public defenders. The remaining public defenders who have excessive caseloads are ethically required to stop accepting new cases according to the American Bar Association.

For example, the New Orleans Public Defender office had 78 lawyers in its office in 2009 and has 36 fewer lawyers today. 3 Ways Emotions Affect Our Health and Action Steps to Change

Our body is always creating new cells. The messages we send it on a daily basis with our thoughts and emotions contribute to what kind of cells are being created. Learning that our body is actually 99.999 percent NEW every 11 months was a key factor in healing myself in three weeks. In looking at how our emotions have and continue to affect our health, we need to look at a few areas of our life. We may need to look at some past traumas and life events to see if those emotions have been processed around them. We will need to be present and recognize the way we speak to our body and the messages we send ourselves. We also need to pay attention to our most common daily emotions to assess what needs some attention shifting and some healing. This work need not be hard or take years. These changes can be subtle shifts and the results we get from these shifts are so powerful that it allows long lasting change to occur as our soul supports us and knows this is for our highest good.

I. Awareness of Your Self-Talk

Begin to listen to your dialogue around your body and health. Do you tend to say things like, “I never get enough rest, I get sick a lot, my (insert body part) is always in pain, I HAVE or AM this dis-ease” or even refer to it as “my” dis-ease. Taking ownership of a disease is not a positive message to send your body if you want to get rid of it. You are claiming it as a part of you and not allowing for other possibilities. I know when I was sick I was in chronic pain and boy did I affirm that any chance I got. “Ow my legs, my stomach, my head, hurt so badly.” I look at it this way — it just makes sense that if our body is always creating cells — what messages we send it and especially the emotions behind those words contribute to what kinds of cells are being made. In telling myself I was sick all the time and it being reaffirmed by doctors constantly, I was not allowing myself to heal.

Action: When you get up in the morning and when you are about to go to sleep — pick one part of your body that DOES feel good or a part of your physicality you are grateful for and affirm you are grateful for it being healthy. When I was healing myself, I started paying attention to the parts of my body that felt good. Even if it was my little finger or toe I would concentrate my full attention on it and think “I am so grateful for this healthy part of me and I know that if there are healthy cells in this part of me it is a possibility for other healthy cells to be created.” The pain started to lessen in a few days and the messages were much more positive than my previous ones of waking up and going to sleep thinking, “Ow my legs are killing me!”

II. Past Trauma

Have you processed emotions around any trauma, issue or challenge that has occurred in your past? When we have faced any kind of trauma from an unhealthy relationship, to physical trauma or abuse, to a great loss or grief to poverty or anything else that had us doubting our physical and emotional safety, there will need to be some processing of emotions and stuck energy around it. There are all kinds of therapies that do this — from traditional psychotherapy to many different alternative therapies. What is most important is that the energy from that incident is not trapped and causing some kind of dis-ease or lack of energy flow in the body as that will translate on the physical or emotional level. There are many ways to release and I do feel it is best to find a way that resonates with you. The fastest tool I have found to transmute these negative energies is the powerful prayer Ho’oponopono. It is a Hawaiian form of healing and prayer and though it’s name may seem complicated, it is the simplest prayer I know and the one I first offer my clients. It is based on the fact that we all contribute to each others’ energy and our reality. Saying this to someone you feel has “wronged you” or even to the situation that was challenging can help transmute the energy. We know what we focus on expands and if we have been feeling a victim to this situation for years, we have not allowed ourselves to begin to heal and move into the present moment where our true power resides. We have kept ourselves in the past. Ho’oponopono offers a way to transmute that energy to begin to heal our relationship with ourselves and forgive and move past what we feel has hurt us in our past.

Action: Say the prayer Ho’oponopono for yourself for 2 minutes and for someone that you feel has hurt you or an event in your life that has been hard to move past. The four sentences that make up Ho’oponopono are:

I love you
I am sorry
Please forgive me
Thank you.

When you are saying it for yourself, imagine your third dimensional self saying it to your soul or Higher Self. When you are saying it for someone else, imagine you are saying it to the soul of that person. Knowing that only people who are hurt, hurt other people. If you are saying it to an event — know that there were tools and gifts you received from that experience that have made you who you are today. Even if it was painful, you might have gained great insight or tools.

III. Everyday Emotions and Focus

Are you sitting in a soup of negativity or do you bring in gratitude? We will have no problem berating ourselves over something we feel we have done or said “wrong” but are you sitting in the gratitude of all you do right? This is the same as self-talk in some ways but goes deeper into what emotions are you predominantly in throughout your day? Do you show gratitude for the things and people in your life that are good or do you sit in what is wrong? Do you ever take the time to give gratitude for yourself and the things you did that day for someone else? I am not saying to walk around all day with a fake smile plastered on. I am asking you to be cognizant of what emotions you usually have and ask that you bring some more positive ones in. Gratitude is the number one emotion to switch up our lives to a much happier space.

Action: Before bed tonight, in the morning before you get out of bed tomorrow or in the shower I want you to take 2 minutes to give gratitude for someone or something in your life. I mean to close your eyes and to sit in it — think of every single thing you love about the person or situation and bring in your senses if you can — sight, feelings around them, smell and sound. You will feel warmer and happier in a few minutes with this focus. Now I ask you do the same for yourself. Think of one thing you did that day or in the past week for yourself or someone else that was nice. It could be as common as cooking dinner for a loved one, it could be you called a friend that you knew was in a bad space, perhaps you let someone ahead of you in line or took a class for yourself or a walk… we always are doing good things for others or ourselves and acknowledging this with gratitude makes that expand and honestly helps stuck energy and to create new energy flow. I say gratitude was the number one tool to help me heal so quickly.

There are many ways emotions can get stuck and create lack of energy flow which contributes to discomfort and dis-ease. These few actions can help to transmute some of those emotions to a healthier state. Learning about the chakra systems as I write about very simply in my book, “A Short Path to Change: 30 Ways to Transform Your Life” as our inner diagnostic system will also help you bring your energy flow back into balance. Confidence doesn’t mean you have all the answers. That’s bluster. That’s wearing a mask. Confidence is humble. Though it may ride on the assuredness of “the attitude of wealth, it also stays open to the reality that the world often delivers what you need, thus “the gratitude of the poor”

True confidence means that though you may not know your next move yet, you’ve got the flexibility and resilience to handle life’s arrows. The One Ritual That Will Change Your Life

On a dreary and cold Monday morning this past January, I woke up with my back stiff and my neck and jaw tight, clear indicators for me of the all-too-familiar signs of stress and overwhelm.

For an entrepreneur, in the middle of launching a brand new program, completely rebranding her company and overhauling her website, and having just signed on several new clients, I was in a familiar place of excitement and blinders-on focus.

My body has a sneaky way of making its needs known when my attention is solely focused elsewhere, blatantly at times. And it finally hit me that my body was fuming at me, “enough is enough!”

So what did I do on that wintery and bleak morning?

I booked a two-week vacation to go hiking in the highlands of Scotland.

And I basically replied to myself, “Who says I can’t launch my new brand overhaul while ON vacation?”

When I’d imagine going on vacation during an expansionary period of my business, I’d immediately tailspin into stories of:

You can’t take a vacation until you complete this launch!
Do you really think you can work and play? That’s not how you create results.
This is not a logical choice; you just went on an extended ski trip.
I just need to put my head down for a couple more months, and work work work!

Oh, the irony.

What I was really telling myself was:

You can’t have fun and play while you’re focused on your business.
You don’t deserve a vacation yet.
I create results from pushing myself rather than trusting that I can be and have it all.

On that morning, I made a promise to myself. No more delaying adventure and joy until work is done. When you love what you do, it doesn’t have to be one or the other, it’s all an adventure.

So I booked those flights without looking back, scheduled a session with my beloved acupuncturist, and planned some time for play in my calendar that week.

By scheduling in my priorities starting with my self-care, I was forced to deal with the deeper issues that were standing on the wings ready to take center stage.

This wasn’t just a vacation; it was about truly loving myself.

Exquisite self-care = self-love

By prioritizing me first, I was training myself to focus on what really matters. Just as the flight attendant always reminds us to put on our own oxygen mask first before helping our neighbors, the same rings true with self-love.

Forward to two months later:

I’ve just returned from two weeks of hiking in the highlands and being one with nature. I never cease to be amazed by how nature rejuvenates the soul.

I spent my days hiking miles upon miles around lochs, exploring picturesque lakes, and falling in love with the Isle of Skye, with the locals, and with myself.

One of the trail markers suggested, “If you feel the connection between soil and soul… why not take the time to also explore…?”

And Great Scott, explore I did!

Fear can often by disguised as reason or logic, “You should stay in the hotel and work today” or “You might regret not completing that now.”

I was prepared for my head game nonsense this time and instead chose to silence the mind chatter, trust myself, and explore.

The more I prioritize me, the easier it becomes.

By the trip’s end, I was thrilled at the prospect of focused time for business building scheduled in my trip calendar, and the rest of the time devoted to exploration.

The more I prioritize me, the more I experience what having it all looks and feels like.

I successfully launched my rebranded company while away, automated many parts of my business, and am returning home “from vacation” rejuvenated, refreshed and inspired.

And not surprisingly, the more I prioritize me:

The more love I have to give;
The better I serve my clients;
The more connected I am with soul and;
The greater tales of exploration I have to experience and share.

If you’re feeling like your life is misaligned, that you don’t have time to play or space to breathe, or that you’re holding on to beliefs that need to be released…

… take a look in the mirror.

Your relationship with yourself is a representation of who you are as a leader and change maker.

Ask yourself these questions this week:

  1. If you are enough for who you are in life versus what you do in life, what choices would you make differently?
  2. What would love choose instead of fear?
  3. How can you treat yourself the way you wish to be treated?
  4. What are 3 promises you can make to yourself this week to be a model of self-love for yourself and the ones you love?
  5. Whether nature connects you with soul or something else (dance, art, music, etc.), what adventure will you embark on this week?

North Korea Claims Missile Engine Test As Advance In Its Nuclear Program

SEOUL (Reuters) – North Korean leader Kim Jong Un supervised a successful test of a new engine for an intercontinental ballistic missile (ICBM), state media said on Saturday, in their latest report of advances in an arms program that has attracted U.N. sanctions.

South Korea and the United States have shown skepticism over the North’s statements about rapid progress in its nuclear and missile programs ahead of a ruling party congress in May, where analysts expect it to declare itself a major nuclear weapons state.

Tension has remained high on the Korean peninsula after the North’s nuclear test and a long-range rocket launch earlier in the year and South Korean and U.S. troops conducted large-scale joint drills amid harsh rhetoric from both rival Koreas.

The engine was ignited at Kim’s command and released a fiery blast, and the test showed the indigenously designed rocket fulfilled all required conditions, the North’s official KCNA news agency said.

“Dear Comrade Kim Jong Un said now we can mount an ever more powerful nuclear warhead on a new intercontinental ballistic rocket and put the den of evil in the United States, and all over the world, within our strike range,” the agency said.

The test was conducted at the North’s missile station near its west coast, where, in February, the country launched a long-range rocket that put an object into space orbit, KCNA said.

South Korea‘s defense officials did not immediately provide comment on the authenticity of Saturday’s report.

The North said in March it had miniaturized a nuclear warhead to be mounted on ballistic missiles and conducted a simulated re-entry test of a ballistic missile, which could indicate advances in its ICBM program, if true.

But South Korean officials questioned those assertions and said the North was several years away from developing an ICBM. The United States said there was no proof of the North’s statements and urged Pyongyang to halt actions that fuel tension. 

The North conducted its fourth nuclear test in January and the rocket launch in February, in defiance of international warnings and past U.N. sanctions, triggering a new Security Council resolution that imposed more punishment.

Despite its assertions, the North has yet to conduct a flight-test of a long-range missile or an ICBM and show mastery of the technology needed to bring a missile back into the atmosphere and hit a target with precision.

The North said its January nuclear test was a successful hydrogen bomb test, but many experts and officials in the South and the United States said the blast was too small to have been from a successful test of such a weapon.
